You asked for a review of our response to your request under the Environmental Information (Scotland) Regulations 2004 (EIRs) of FoI 202200279512 on Deposit Return Scheme meetings.

Response

I have now completed my review and I have concluded that the original decision should be confirmed, with the following modification:

Some of the information you requested was withheld under exception under 10(4)(e) and 10(5)(f) of the EIRs regulations. These exceptions are subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, I have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. I have found that, on balance, the public interest lies in favour of releasing some of the information that was previously withheld. I have attached an amended version of the copy of the minutes provided to you in the letter of 12th April 2022 and for ease of reference have highlighted the additional material which has been released in yellow.

Some of the information you requested was withheld under regulation 11(2) of the EIRs (personal information) and I have upheld the decision to withhold this information. However, I have made some annotations in the enclosed document to make it clearer which parts of the minutes this exemption has been applied to.
