Information requested

A copy of all documents which discuss the Government being made aware of, and deciding how to respond to, the Scottish Liberal Democrat press release on 12th May 2023 around the number of additional interim care beds that Humza Yousaf announced on 10th January 2023 including all correspondence involving ministers, Special Advisors and the media office.

We append a copy of all of the information you requested. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) (personal information)] of FOISA applies to that information. The reasons why that exemption(s) applies are explained below.

An exemption applies

We are unable to provide a small amount of the information because an exemption under section 38(1) (b) (personal information) of FOISA applies. This is because it is the personal data of a third party, i.e. the names and contacts details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
