Information requested

Provide any and all correspondence between First Minister Humza Yousaf and Prime Minister Rishi Sunak since Mr Yousaf became First Minister on March 28?

This might include emails, letters or details/minutes of meetings, telephone calls, SMS/Whatsapp messages between Mr Yousaf and Mr Sunak.

Can details/minutes of their first meeting in London in late April be provided amongst these?

Our aim is to provide information wherever possible and I enclose copies of most of the information you requested. However, exemptions under sections 28 (1), 30 (b) (i), 38(1)(b) and 39 (1) of FOISA apply to some of the information you have requested. Some of these exemptions are subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the relevant exemptions.

Exemptions under section 38(1)(b) of FOISA apply to some of the information you have requested. This concerns personal data of third parties and is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

Further exemptions applied to some information under: s.28(1) (relations within the UK); s.30(b)(i) (free and frank provision of advice); and s.39(1) (Health and Safety). Taking into account all the circumstances of this case, we have considered if the public interest test in disclosing the information outweighs the public interest in applying the exemptions. We have found that, on balance, the public interest lies in favour of upholding the exemptions.
