In relation to the interpretation of a non-executive Director being part of the hearing panel, one board has sought clarification and requested further information on this point.

Response
The NHS Board involved and the date of the clarification requested (as referenced in the response referenced) I can confirm that the NHS Board which sought clarification was NHS Dumfries & Galloway. The request came in the summer of 2022. Details of the clarification requested. The Board requested clarification around the inclusion of a Non-Executive Director for every appeal against dismissal and whether not including a Non-Executive Director on such a panel would constitute a breach of the policy Details of the clarification provided. This is a S.17 Exemption under the Freedom of Information (Scotland) Act 2002 - Notice that the information is not held. Clarification has not yet been provided. This is currently being considered by the Scottish Workforce and Staff Governance Committee (SWAG) in line with the relevant governance process.
