Correspondence between Minister for Trade and Tom Hunter Foundation: FOI release
Information requested
All correspondence between Ivan McKee, Minister for Trade, Innovation and his civil servants, and Tom Hunter of the Hunter Foundation. I am looking for copies of all letters, emails, minutes of meetings, presentations, reports, and messages via Whatsapp, Signal or similar from April 2019 until May 2021.

Having undertaken a search of the Scottish Government’s correspondence management systems, and our electronic Records and Document Management system, we have identified one item of correspondence relevant to your request, which I have attached with this letter. Further information on what exemptions apply and why can be found below.
While our aim is to provide information whenever possible, I am issuing a formal notice under section 17(1) (Information not held) of FOISA stating the Scottish Government does not hold correspondence between Mr McKee and Sir Tom Hunter of the Hunter Foundation. This is because they did not meet between April 2019-May 2021.
However, I have enclosed correspondence between Scottish Government officials and Sir Tom Hunter of the Hunter Foundation. An exemption under section s38(1) (Personal data) of FOISA has been applied to some of the information containing personal data of a third party, i.e. names and contact details. Disclosing this information would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
