Information requested

The number of prosecutions and convictions for breaches of Section 103 of the Licensing (Scotland) Act 2005 for years 2019, 2020, 2021, and 2022 to date. Is it also possible to break down whether the convicted offender was an off-licence or pub/club?

Response

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested. Specifically, we do not hold information on accused parties that would allow us to identify a company type (e.g. off licence or pub/club). The Scottish Government Criminal Proceedings database is not a live system and the latest available information is for the financial year 2020-21. Statistics are presented on the number of people dealt with by the Scottish Criminal Justice System where proceedings have concluded. For the period from 2018-19 to 2020-21, our records show there was one prosecution in Scottish courts in 2018-19, which resulted in a not-guilty verdict. The main charge was prosecuted under Licensing (Scotland) Act 2005 Section 103(1)& 141B. About FOI
