Information requested

1. Any Scottish Government Cabinet Meetings where James Hamilton QC’s Ministerial Code investigation was discussed. If it was discussed, please provide any minutes or notes on these discussions. Please limit time period to 1 January 2019 and the present date. 2. Any correspondence (including emails, attachments, typed or handwritten notes, letters, notes/records of phone calls, minutes of meetings, briefings or otherwise) from the First Minister’s office regarding James Hamilton QC’s Ministerial Code Investigation. Please limit the time period from 4 November 2020 to the present date.

Response

With regard to the first part of your request while our aim is to provide information wherever possible, in this instance the Scottish Government does not have the information you have requested. The reasons why we don’t have the information are explained in Annex A to this letter.

With regard to the second part of your request I enclose a copy of some of the information you requested. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under section (30) (Prejudice to the Effective Conduct of Public Affairs) of FOISA and section 38(1)(b) (Personal Information) applies to that information. The reasons why those exemptions apply are explained in Annex A to this letter.
