Information requested

'Copies of all of correspondence, notes of calls, and memos between Education Scotland and Kilgraston School, their representatives, or their solicitors.

Copies of all inspection reports of independent schools by the Registrar of Independent Schools, between 21 January 2015 and 21 January 2018. If it makes the request easier for you to manage, I am interested only in reports where improvements or changes were ordered or recommended.'

Response

Please find attached correspondence sent to Kilgraston School. However, while our aim is to provide information whenever possible, in this instance we are unable to provide some of the information requested because an exemption under section 38(1)(b), personal information of FOISA applies to some of the information requested.

The reason why this exemption applies is explained below.

Reasons for not providing information

Section 38(1)(b) - personal information.

An exemption under section 38(1)(b) of FOISA (personal information) applies to some information which has been redacted from the enclosed documents. This exemption applies because the information is personal data of a third party and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998.

This is because releasing this information could lead to the identification of staff members.

This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
