“For the period 1 January 2024 to 31 December 2024, please provide:
1. Any ministerial submissions, briefings, advice notes or memoranda prepared during 2024 that relate to the development, consideration or justification of a direct award of the ferry services contract to CalMac Ferries Ltd.
2. Any internal recommendation papers, options appraisals or summary documents produced during 2024 that discuss procurement options for the ferry services contract and refer to a direct award to CalMac Ferries Ltd.
I am content for this request to be limited to final or near-final documents where inclusion of drafts would materially increase volume.”

1. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption(s) under section(s) 25(1) (Information otherwise accessible), 29(1)(a) (development of government policy), 30(b)(i) (free and frank provision of advice), 30(c) (Otherwise prejudice effective conduct of public affairs), 33(1)(b) (commercial interests), 33(2)(b) (financial interests of a UK administration), 36(1) (confidentiality in legal proceedings) and 38(1)(b) (personal information) of FOISA applies to that information. The reasons why that exemption(s) applies are explained in the Annex to this letter.
