Response
As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA. This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request. The speed survey in Garve covered 4 sites, 2 of which where in the 40mph zone and was carried out over a period of 7 days. Details of the vehicle numbers within each of the speed ranges requested at the locations within the 40mph zone are contained in the tables below. The total number of vehicles recorded at each of the sites over the same period was 23,237 at Site 2 and 22,651 at Site 3. These numbers, and those reported in the tables below, represent both northbound and southbound vehicles. Site 2 - Approximately 180m north of the 40mph speed limit at the south end of Garve
Speed (Mph) Number of Vehicles 41.00 - 45.99 4,376 46 - 50 793 50.01+ 316
Site 3 - Near Stirling Drive
Speed (Mph) Number of Vehicles 41.00 - 45.99 2,342 46-50 362 50.01+ 107
