A copy of the text of the case filed by the Lord Advocate in relation to the Reference to the Supreme Court made by her on 28 June 2022.

Response

A PDF copy of the Lord Advocate’s Written Case is attached as Annex A of this letter. While our aim is to provide information whenever possible, in this instance, an exemption under section 38(1)(b) (personal data of a third party) of FOISA applies to a small amount of the information requested. The reasons why this exemption applies is explained in Annex B of this letter.
