Information requested

You asked for any briefings provided to Scottish Government ministers or correspondence between Disclosure Scotland and Scottish Government ministers (particularly Maree Todd and John Swinney) or special advisers regarding IT problems/issues at Disclosure Scotland in the last three months.

Response

I enclose a copy of most of the information you requested in Annex B.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under s.38(1)(b) of FOISA applies. The reason why that exemption applies is explained in Annex A to this letter.

Annex A - Reasons for not providing information An exemption applies

An exemption(s) under s.38(1)(b) of FOISA applies to some of the information you have requested as it relates to personal information. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption
