1. Please can you please provide the most up to date valuation for the total of CPO and landowner compensation for AWPR & A90 Dualling Balmedie to Tipperty Projects?

2. Please can you confirm if the publicised £745 million fixed price cost for AWPR & A90 Dualling Balmedie to Tipperty Projects is inclusive of the above total value of CPO and landowner compensation?

As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

The total estimated compensation for the purchase of land required for the construction of AWPR & Balmedie to Tipperty, including the amounts already paid, is £135.9m (£127.7m on AWPR & £8.2m on Balmedie to Tipperty).

I can confirm that the published figure of £745m at Q4 2012 rates for the AWPR/B-T project is an estimate of the overall cost of preparation,construction and landowner compensation of the AWPR/B-T project, taking account of costs incurred at the date of preparation and estimates of costs to be incurred subsequently.
