Response
You requested a copy of a salaried reporters employment contract. If I might firstly clarify that an exemption under section 38(1) (b) of FOISA (personal information ) applies to information requested which would specify (or detail) a particular reporter's employment contract. This is because it is personal data of a third party and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
However, if it may be of some assistance, I attach, for your convenience, a copy of the standard Terms and Conditions of Appointment, the details contained within which are sent out in any (standard) permanent contract. This would be relevant to any Scottish Government employee, including salaried reporters.
