Can you please supply a copy of the text of the Reference to the Supreme Court made by the Lord Advocate on 28 June 2022.

A PDF copy of the Reference to the Supreme Court made by the Lord Advocate is attached as Annex A of this letter.

While our aim is to provide information whenever possible, in this instance, an exemption under section 38(1)(b) (personal data of a third party) of FOISA applies to a small amount of the information requested. The reasons why this exemption applies is explained in Annex B of this letter.

You may be interested to note that the Lord Advocate’s Reference to the Supreme Court, as attached in Annex A, was published on 5 July 2022 and is available on the Scottish Government website at the following link: Reference to Supreme Court: whether the question for a referendum on Scottish Independence contained in the proposed referendum Bill relates to reserved matters - gov.scot (www.gov.scot).
