Information requested

Any correspondence or briefings (including emails, attachments, typed or handwritten notes, letters, notes/records of phone calls, minutes of meetings, briefings, WhatsApp messages or otherwise) received by transport minister Jenny Gilruth or Kate Forbes regarding ‘EU state aid rules’ in the period 1 January 2022 to 11 May 2022.

Response

I enclose a copy of some of the information you requested in the format you asked for. Please note, you will notice one document included was incorrectly dated January 2021 when it was in fact created in January 2022. You may also note a group of emails and documents dated August 2021 – these are pertaining to a separate FOI release (Reference: 202200275543) of which the email and document came within scope of the timeline for this FOI request (our reference: 202200299753). For the sake of transparency, we have therefore included these in full.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption(s) under section(s) 25 – Information otherwise Accessible, 30(b)(i) - Free and Frank Provision of Advice, 30(b)(ii) - Free and Frank Exchange of Views, 33(1)(b) - Prejudice to Commercial Interests, 36(1) - Legal Advice and Section 38(1)(b) - Third Party Personal Information of FOISA applies to that information. The reasons why that exemption(s) applies are explained in the Annex to this letter.
