Information requested

Information under the Environmental Information Regulations 2004 and the Freedom of Information (Scotland) Act 2002 regarding the Cost of Living (Tenant Protection) Scotland bill 2022.

Copies of all correspondence, sent and received, between the Scottish government and representatives of HM the Queen, including the Queen's legal representatives, regarding the Cost of Living (Tenant Protection) Scotland bill prior to it being passed by the Scottish parliament, including but not exclusively all correspondence and any additional information provided dealing with crown consent for the bill. All internal Scottish government documents, including but not exclusively minutes, memos, emails and explanatory papers, including but not exclusively those written for ministers, regarding the application of crown consent to the Cost of Living (Tenant Protection) Scotland bill prior to it being passed by the Scottish parliament. All internal Scottish government documents, including but not exclusively minutes, memos, emails and explanatory papers, including but not exclusively those written for ministers, regarding the application of crown consent to new bills being introduced to the Scottish parliament from 1 July 2022 to date. All Scottish government correspondence to and from the Presiding Officer of the Scottish parliament and with any other officials of the Scottish parliament regarding the application of crown consent to new bills being introduced to the Scottish parliament from 1 July 2022 to date.

Exemptions under section(s) 38(1)(b) and 41a of FOISA Communications with the Royal Family and honours applies to some the information you have requested. The exemption under section 38(1)(b) applies to third party personal data. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

The exemption under section 41(a) applies to communications with the Royal Family. This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption.
