As the information you have requested is ‘environmental information’ for the purposes of the EIRs, we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA

Response

Further to my letter of 23 March 2023, I have now completed my review to your request under the Environmental Information (Scotland) Regulations 2004 (EIRs). You had requested a review as the officer had not demonstrated that the public interest had been considered when withholding information requested by you.

I have concluded that a new decision should be substituted.

In my review I considered that it was not appropriate to withhold information under either regulation 10(4)(d) or 10(5)(f) and have concluded that this information should be released.

Accordingly I have enclosed a copy of the information you have requested.
